Kai-Kai Farm CSA Share Terms and Conditions Agreement

We, the farm, wish to provide you with fresh, local, seasonal food and you, the purchaser, wish to receive a portion of our harvest. This agreement outlines our shared commitments to that relationship.

Section 1. Introducing Our CSA Farm

A. BECOMING A PART OF OUR FARM

Community Supported Agriculture (CSA) is a relationship between our farm and you as our customer. Rather than simply purchasing vegetable items, our customers become “CSA share buyers” and they in turn receive a portion of the farm’s harvest.

Our CSA pickup schedule runs from November to May. As a Share buyer, you are responsible for showing up at the farm to pick up your share of freshly harvested vegetables. You will receive a half-bushel box or equivalent of vegetables. Detailed information regarding pick-up is discussed below in Section 3. Variety and quantity may vary, as described below in Section 2.

Section 2. Our Commitment

We promise to do our best to provide you with a bountiful share every box. Kai-Kai Farm takes produce quality seriously. That is why the best restaurants in the region buy from us every week during the season. The items vary somewhat from week-to-week or period-to-period due to seasonality, the weather, pests, or seed availability. We make every effort to give the CSA customers the finest quality and we rarely fail but if you are not satisfied call our office and we’ll arrange replacements.

Section 3. Getting your Share

A. RECEIVING FRESH PRODUCE

Please pick up your share as scheduled, and some recommendations follow.

1. Bring your own bag if possible.

2. Pick up your share within the timeframe stated.

We take the safety of your food seriously. We have an employee responsible for packing house sanitation, and a Serve Safe-certified employee is always on duty during business hours. For your added protection, wash all produce before eating.

B. IF YOUR SCHEDULE CHANGES

No-shows: Sometimes events interfere; If you cannot pick up your share, please arrange for someone else to pick it up for you. You are responsible for explaining the pick-up location and procedures to your substitute. As produce is perishable uncollected shares are forfeited. Due to the high cost of transportation, we no longer deliver CSA boxes.

Section 4. Refunds

REFUND BY CHECK ONLY

Sometimes our share buyers must re-locate, or for other reasons, they choose not to continue receiving produce from Kai-Kai Farm. They may want some of their shares refunded, so we have a simple solution.

Your no-questions-asked refund is calculated according to your GrownBy purchase:

For Kai-Kai Farm CSA Shares: The price per box you pay for received produce will be based upon the retail price of $53. For example, if you purchased the share “CSA 11 Boxes Weekly: Spring” for $494.01 in FULL, received 3 of those boxes ($53 x 3=159), amount paid $494.01 less $159.00 = $335.01 refund.

If the share “CSA 11 Boxes Weekly: Spring” is being paid in monthly PAYMENTS, and you have received only 2 boxes, then the price per box you pay for received produce will be based upon the retail price of $53. For example, $53 x 2=106, amount paid (deposit & 1st monthly payment) $197.60 less $106 = $91.60 refund.

Section 5. Communicating with Us

The best way to communicate with Kai-Kai Farm is via email, text message or telephone. The best time to reach the office team is between 9 AM – 3:30 PM. For questions about the produce call the office 772-597-1717 or text us at 772-888-0903. We will do our best to respond as soon as possible. Please contact us with any news of the following:

1. Your pickup day

2. Problems with your schedule

3. Concerns about our produce or share

Generally, we will communicate by email. When you sign up, you will be added to our email list. We depend on being able to communicate important information, such as necessary changes to your schedule. Periodically, we will email an update giving you information about the crops currently available, farm events, or other farm news.

Section 6. Your Pledge

By purchasing a CSA Share, I agree to the terms above. I understand that, although unlikely, the farm may occasionally change parts of this agreement related to production and distribution. These changes will be forwarded to me in advance via email.

We wish to thank Rachel Armstrong at FarmCommons.org for providing us the framework from which the above agreement was created.
